Terms and Conditions

I - PURPOSE, SCOPE AND DEFINITIONS

1) These general conditions regulate the sale, including registration, ordering and access to "ESC" products offered by Trapézio Previsível Unipessoal, Lda, with NIPC 515 478 920, registered with the CRC of Vizela with the same number, with headquarters at Rua da Lage, 343, Apartado 275, municipality of Vizela, on the website www.esc---store.com and apply to all contracts for the purchase and sale of "ESC" products concluded between Trapézio Previsível Unipessoal Lda and any user who places orders through said website.
 
2) For the purposes of these general conditions, the following definitions apply:
 
a) - "ESC" - Products sold by Trapézio Previsível Unipessoal Lda, holder of all copyright or related rights, as well as other rights that may be subject to protection provided for in the Industrial Property Code, on the website/page with the address above and supplier of the goods available for order on the same site;
 
b) - "User" - Any natural person, not a trader, who places an order through the website/page www.esc---store.com ;
 
3) These general conditions do not exclude the User's rights and guarantees contained in the legislation in force for contracts of this nature.

II - ACCEPTANCE

1) The conclusion of purchase and sale contracts for ESC products presupposes the User's knowledge and acceptance of the General Conditions.

2) By accepting the General Conditions, the User confirms having read the General Conditions, having the legal capacity to accept them and to enter into the purchase and sale contract for ESC products.

III - REGISTRATION

1) To place an order, the User must first register by filling in the fields on the form available on the website www.esc---store.com .

2) After registering as a customer, the User can access his/her personal account online by logging in, after entering a personal and non-transferable password, chosen by him/her, at the time of registration.

3) From the moment you access your personal online account, the User is subject to these general conditions, as well as the legal and regulatory standards that govern their operation and use.

IV - ESC PRODUCTS

1) The site www.esc---store.com is aimed at users of ESC products who wish to purchase ESC products from their home or workplace, 24 hours a day, 7 days a week.

2) Information on the essential characteristics of ESC products can be found at www.esc---store.com .

3) Trapézio Previsível Unipessoal Lda reserves the right to modify, at any time, the information, the offer of ESC products, prices, promotions and commercial conditions, presented on the website. www.esc---store.com .

V - ORDERS/ORDERS

1) After accessing your personal account created on the website www.esc---store.com , the User may proceed to purchase ESC products online, following the following steps:

a) Selection, through the search icons or menus, of the product(s) desired by the User;

b) Adding the selected product(s) to the User's "Shopping Cart";
 
c) Registration of the User's personal data, with the option of integrating them into the Trapézio Previsível Unipessoal Lda database under the terms set out in the General Conditions;
 
d) Indication of the "Delivery Location", "Billing Location" and "Payment Method";
 
e) Entering the User's tax identification number (NIF);
 Trapézio Previsível Unipessoal Lda, will make all purchase details available through the website www.esc---store.com , allowing the identification and correction of any errors and will request acceptance of the terms and conditions of the purchase, as well as the General Conditions;

 
3) The User will be informed of the status of their request/order by receiving an email message, regarding the “Order Confirmation”, and a second message, after payment validation, regarding the “Order Dispatch”.
 
4) Finally, the User's order/request will be delivered by the logistics operator to the "Delivery Location" indicated in the purchase process and with the corresponding detailed invoice.
 
5) Placing an online order for products included in the "Shopping Cart" represents the User's acceptance of the purchase of the same, at the prices and under the terms described on the website www.esc---store.com , and the User may only place orders through the website www.esc---store.com with the prices, terms and conditions announced therein.
 
6) In the event that Trapézio Previsível Unipessoal Lda, for any reason, does not accept the User's request, a right that Trapézio Previsível Unipessoal Lda expressly reserves, the User will be informed of this fact.
 
7) The fulfilment of all orders placed on the aforementioned website is subject to the availability of Trapézio Previsível Unipessoal Lda, which will attempt to ensure that all products offered for sale on the website are in stock. However, Trapézio Previsível Unipessoal Lda reserves the right not to accept any orders or to cancel orders already confirmed for products for which there is no stock, and in these cases, Trapézio Previsível Unipessoal Lda will inform the User of such fact and will refund the amount received within 30 days.
 
8) Trapézio Previsível Unipessoal Lda will not accept order requests in relation to one of the following situations:
 
a) The "Delivery Location" is located outside Mainland Portugal, Portugal Islands (Azores/Madeira);
 
b) The total value of the order is greater than €1,500.00 (one thousand and five hundred euros);
 
c) The purpose of the purchase is the resale of the products;
 
d) The product is not available in the warehouses of Trapézio Previsível Unipessoal Lda (in which case the User will not be able to add the product to the "Shopping Cart");
 
e) Payment is not made using any of the payment options available on the website www.esc---store.com ;
 
f) Payment is not confirmed.

VI - PRICES

1) All ESC product prices indicated on the website  www.esc---store.com , include Value Added Tax (VAT) at the rate of 23% or at the rate that, at any time, results from the legal provisions in force. The total VAT to be paid by the User will be indicated on the invoice to be sent to the User.

2) The prices of ESC products, as well as their characteristics, are subject to change without prior notice from Trapézio Previsível Unipessoal Lda. However, said changes will be published on the website.  www.esc---store.com with the aim of keeping users informed, and it is understood that the User was aware of them before placing the order.

3) If there is an error in the price of the products ordered, either Trapézio Previsível Unipessoal Lda or the User may, at any time, up until the products are shipped, cancel the order.

4) Prices are always subject to final validation and in accordance with the invoice issued for the purchase.

VII - PAYMENT METHODS AND SECURITY

1) To promote the privacy and security of documents and information to be transmitted over the Internet, the User may pay for their purchases through the payment management entity, Unicre. — Financial Credit Institution, SA, with registered office at Av. António Augusto Aguiar, 122, 1050-019 Lisbon, Portugal, EuPago - Payment Institution, Lda., with registered office at Rua do Paraíso, 258, 4000-376 Porto Portugal - Institution supervised and registered with the Bank of Portugal under no.

2) For this purpose, Unicre will make payment available via MBWAY or credit card (Visa, Master Card) and the conditions and terms relating to the Credit Card are available at the time of consultation/payment.

3)  For this purpose, EuPago will make payment available via multibanco references, the terms and conditions of which are available at the time of consultation/payment.

4) KLARNA — Pay in 3: with this solution you can split the payment for your purchase into 3 installments. The first installment is paid when the product is shipped, the second in 30 days and the third in 60 days. Of course, this is without interest or additional costs for you. Minimum amount of 50 euros and maximum amount of 1500 euros. Payment can be made in installments using a debit/credit/prepaid card.

VIII - DELIVERY COSTS

1) Standard delivery costs will be borne by Trapézio Previsível Unipessoal Lda, only in Mainland Portugal, for orders over €79, in accordance with the promotional conditions in force at any given time.

*Average delivery times indicated refer to the order dispatch date and are presented in working days (Saturdays, Sundays and holidays do not count towards delivery times). In cases of force majeure, Trapézio Previsível Unipessoal Lda cannot be held responsible for delays in delivery.

IX - DELIVERY

1) Trapézio Previsível Unipessoal Lda will ship the product or products ordered by the User, from Monday to Friday, with the exception of holidays and on the days and time periods used by the logistics company, to the address indicated by the User at the time of confirming the order.

2) Trapézio Previsível Unipessoal Lda undertakes to fulfil the order between the 2nd day after payment and within a maximum period of 8 days from the date of payment validation.

3) Trapézio Previsível Unipessoal Lda will inform the User of the unavailability of the product or products ordered, and will refund the amounts paid for such product or products, within a maximum period of 15 days from the date of knowledge of such unavailability.

4) Trapézio Previsível Unipessoal Lda's ability to respond within the aforementioned deadlines is, however, dependent on the availability of its stock.

5) If the carrier is unavailable to deliver the products on the date indicated, the User will be contacted to provide another delivery date.

6) The order is considered dispatched from the moment Trapézio Previsível Unipessoal Lda delivers it to the carrier, who will be responsible for its delivery to the User, under the terms set out below:

- The products will be sent and delivered to the User by the carrier, who will be responsible for any delay in the delivery of the order.
- If no one is found to receive and sign the confirmation at the "Delivery Location", the logistics operator will not deliver any product.
- In this case, the User will be contacted by the carrier responsible for delivering the order in question, to make a new appointment for the carrier to deliver the ordered product, in which case a cost of €5 will be charged to the User.

7) A delivery is considered to have been made or a product is considered to have been delivered upon signature of the delivery receipt at the agreed address.

X - RETURNS AND CANCELLATIONS

Cancelling an order before shipping:

1) The User may cancel the order of products without any associated cost, as long as they have not yet been shipped.

2) If the User places an order and wishes to cancel it, he/she must immediately contact our Customer Support Service and request the cancellation of his/her order via email customer@esc---store.com . Only after this procedure is it possible to cancel the order. If the cancellation request is successful, the User will be notified by email of this decision and the cancellation will be processed at no cost to the User.

Return of defective products:

1) The User has the right to return the products delivered if they are found to be defective or otherwise non-conform to the products ordered, and the return must be made within 30 days of receipt of the order. This does not affect your statutory rights. If your complaint is justified, the price paid for the product will be refunded and you will be contacted by the logistics company in order to arrange a date and time to return the defective product(s). Product Returns:

1) The User may return the product(s) ordered 30 days after receipt, provided that:

a) The products have not been used,
b) The product maintains its original characteristics and labels intact;
c) All shoes have been tried on a carpeted surface before wearing/using them;

2) For information regarding returns, please consult the Exchanges and Returns .

3) Once the returned product has been received, Trapézio Previsível Unipessoal Lda will analyze and confirm its condition and, when applicable, will refund the amounts paid by the User within a maximum period of 15 (fifteen) days, without any expenses for the User.

4) If the returned items are damaged or worn, Trapézio Previsível Unipessoal Lda reserves the right not to accept the return and also to refuse to refund the same.
