At ESC we are aware of our legal responsibility as “data controller” and we support the data protection principles reflected in Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, applicable from 25 May 2018.

ESC, a registered trademark of Trapézio Previsível Unipessoal Lda, guarantees that your personal data is processed in Portugal, maintained, used, transferred and treated in accordance with our legal obligations. We will continue to process data for marketing purposes in the national territory and by our ESC franchisees.

This Privacy Policy does not apply to websites that you may access via links on the Website and/or activities offered by third parties. Please ensure that you review any relevant policies on third party websites before proceeding. ESC is not responsible for the collection or use of your personal data on these third party websites.

CHANGES TO THIS POLICY

ESC will notify its customers of changes to this Privacy Policy by posting the amended terms on the Website. If you do not agree to the new terms of this Privacy Policy, you should stop using the Website. If you are a registered customer, you can cancel your account with us by contacting us. Your account will be closed and you will not be bound by the new terms. As a Customer, you can also request that we delete your information. Otherwise, your continued use of the Website after the effective date of the changes constitutes acceptance of the new terms of this Privacy Policy.

HOW DO WE STORE AND PROTECT YOUR DATA?

The data we collect is transferred, processed and stored by the following entities: SHOPIFY, OFICINAWARE, DPD, Klarna Bank AB, euPAGO, UNICRE.
We store your data on secure servers using cyber security and organisational measures to protect your personal data and reduce the risk of loss, misuse and unauthorised access, disclosure and alteration. Some of the safeguards we use include firewalls and data encryption, secure physical access to our data centres and secure access to information. However, please understand that no system is perfect or can guarantee that unauthorised access or theft will not occur. Where we have provided you with a password which enables you to access restricted areas of the website, you are responsible for keeping this password confidential. We ask that you do not share your password with anyone. The transmission of information via the internet is not completely secure. We will do our best to protect your personal information, but we cannot guarantee the security of data transmitted through the website; any transmission is therefore at your own risk. Once we have received your personal information, we will use strict procedures and security features to try to prevent unauthorised access.

HOW TO PROTECT MINORS' INFORMATION

LEGISLATION

Contracts for the purchase and sale of products through this website are regulated by Portuguese Law.

MARKETING NEWSLETTERS AND/OR COMMUNICATIONS

ESC transmits information about products, services, events, sales and marketing (including personalized online content and advertising via the website www.esc---store.com, social networks or online partners).

We will send you marketing messages when you tick the relevant boxes when checking out, sign up for newsletters or updates or register with us via the website, by phone, by email or directly in store.

As our customer, you have the opportunity to clearly define how you wish to be contacted. If you are registered, you can also manage your preferences by updating/changing the privacy settings in your account.

We will not share your personal information with companies outside the ESC Group and business partners, without your explicit prior consent, for them to contact you for marketing purposes.

WHAT PERSONAL INFORMATION DO WE COLLECT AND HOW?

Your personal data is collected and processed by ESC, only for purposes strictly linked to the use of this website and in ESC stores, with a view to providing an excellent service during and after the product purchase experience.


1 - Information we record about you:

  • When you register on our website or transmit your data to our retailers to receive our newsletter and/or updates;
  • When you participate in special day campaigns in our physical stores or through our online store;
  • When you register on the website, by phone or by email, or provide personal information that you fill in, or that we complete at your request in the store;
  • When you make a registration request on our website;
  • If you ask us to keep in touch;
  • If you ask us to send you personalized online content, such as targeted advertising;
  • If you complete a survey or send us feedback about our products, websites or stores;
  • If you contact us (for example by phone, email or otherwise) to find out more about a product or our after-sales service and support, to report a problem with the website or a product or for any other reason.

The personal information you provide to us may include your first and last name, title, gender, date of birth (day and month), email address, telephone number, address, financial information (e.g. IBAN), as well as billing address and any other information you consider necessary to provide to us.

Your personal data may also be used for other processing operations that fall within the limits of these uses:

Whenever you carry out a purchase process for products sold on this website or in any of our physical stores, we collect your personal data (for example, size, email address, delivery address and telephone number) on the purchase form, solely for the purposes of selling, separating and transporting the products ordered.

b. Whenever you request service assistance, we collect your personal data (e.g. name, email address) for the purpose of providing you with the Customer Support services of the online or physical store that are relevant to this website and assistance;

c. Whenever you save a delivery address, we collect your personal data in order to simplify the preparation of your future orders.

d. When using the Klarna payment method, during the purchase process, your personal data included in the contact form and order details, so that Klarna can evaluate your access requirements and payment methods and adapt these payment methods to your profile.
Your personal data is processed in accordance with the provisions of Klarna's privacy policy.

Your personal data will only be communicated to third parties when it is necessary to process an order. Your personal data will be disclosed in the following cases:


a. Payment and/or refund services;
b. Processing of purchased products;
c. Select, pack and ship items;
d. Resolve questions or doubts related to the sale of products;
e. Process payments for the purchase of items;
f. Process item returns.


2. Information that our physical stores record about you:

Name, address, gender, date of birth, telephone number, email address, tax number, size, this is the information we may receive about you when you make a purchase in one of our stores, if you fill in the store's customer form. Please note that the ESC customer form is the same for all physical stores, so you will not be asked for any other information/data other than that already mentioned above.
These stores will also provide us with a record of your transaction.

3. Information we receive from other sources about you:

We work closely with third parties, such as business partners, subcontractors for technical, payment and delivery services, advertising networks, analytics providers and search information providers. If we receive information about you, we ask for assurances that our partners pass on information in accordance with data protection laws and that they are transparent with you about sharing your data with us. We may use this information to update our records about you and keep them up to date.

WHAT ARE YOUR RIGHTS?

The Customer has the following rights in relation to his/her personal information:

  • Access. The Customer has the right to access the data we hold. We will require the Customer to prove their identity before we provide any personal data.
  • Rectification or erasure. You have the right to request that ESC rectify or erase any personal data we hold about you (unless we have a legal right or obligation to retain it).
  • Restriction. The Customer has the right to restrict the use of personal information if the data is inaccurate, if the use of the information is unlawful or if it is no longer necessary to use the data for the purposes for which we store it.
  • Changing your preferences. You can change your data processing preferences at any time. For example, if you have given your consent to direct marketing but have changed your mind, you may opt out of receiving marketing communications by contacting us using the details provided below or by clicking on the “Unsubscribe” link in any communication you receive.
  • Automated decision-making. If you have any concerns about our automated decision-making processes or their accuracy, you should let us know or change your preferences.
  • Data portability. The Customer has the right to obtain the personal data that ESC holds, in a structured electronic format, and to transmit such data to another data controller, where they are:

(a) personal data that the customer provided to us;
(b) where such data is processed on the basis (such as marketing preference information) or to perform a contract with you (for example, to manage your online account).

  • Complaints. If for any reason the Customer is not satisfied with the way we handle their personal data, please contact ESC.

If you request that we stop processing your personal information for certain purposes or that we erase your personal information, which is necessary to facilitate your use of the Website or to enable us to provide you with a service (such as managing your online account), you may not be able to use the Website or the Service as you used to. This does not waive your right as a customer to object to direct marketing, which you can exercise at any time without restriction. Please allow at least 3 business days for your request to be completed.

WHO SHARE YOUR PERSONAL DATA?

Your data may be stored in a database that we can access. We are your point of contact.

We will also share your data with SHOPIFY, OFICINAWARE, DPD, Klarna Bank AB, euPAGO, UNICRE who provide data storage facilities for us.

We may also share your data with the following categories of third parties selected in accordance with this Privacy Policy:

  • Service providers (e.g., IT services), business partners, suppliers, and subcontractors for the performance of any contract entered into with our customers (such as, but not limited to, website operations, payment services, shipping, fraud investigations, bill collection, and affiliate and rewards programs);
  • Analytics and search engine providers who assist us in improving and optimizing the website;
  • Law enforcement or regulatory agencies, or authorized third parties, in response to a verified request relating to a criminal investigation or alleged illegal activity or any other activity through the Site that may expose ESC and/or the customer or third parties to legal risk or liability;
  • Other business entities, in the event of a business split or merger. Should such a combination occur, we will require the new entity to follow this Privacy Policy in relation to your data. Such third parties that may receive your data will process such data for the purposes specified above and in accordance with applicable law. ESC will maintain a list of the third parties with whom data is shared, which will be available upon request by the customer.
